1. Scope

These terms apply to all orders in the online shop https://shop.mush-room.net/en between you and THOMARA Edelpilze & Feinkost, owner Thomas Markus Rave, Bergstraße 64, 69120 Heidelberg, Germany (hereinafter ‘we’). The online shop belongs to the mush room shop, Römerstraße 28, 69115 Heidelberg.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity (§ 13 BGB).

2. Conclusion of the contract

The presentation of the products in the online shop is a non-binding invitation to order. By clicking ‘Order with obligation to pay’ you submit a binding offer to purchase the goods in the shopping basket. We confirm receipt immediately by e-mail. With this order confirmation we accept your offer, and the contract of sale is thereby concluded.

Before you submit the order, the ‘Review order’ page shows all details once again. Input errors can be corrected there via ‘Change’ and in the shopping basket. The language of the contract is German.

We store the text of the contract. We send you the order details and these terms with the order confirmation by e-mail. The order can be accessed again at any time via the link in this e-mail. The current terms are always available at https://shop.mush-room.net/en/terms.

3. Prices and shipping costs

All prices are final prices and include statutory VAT. Shipping costs are added, as listed at https://shop.mush-room.net/en/shipping and shown before the order is submitted. Collection from the shop is free of charge.

For deliveries to countries outside the European Union, customs duties, import taxes and fees may apply. These are borne by you.

4. Payment

The checkout shows which payment methods are available. Depending on the order, these are bank transfer in advance (prepayment), PayPal, card payment and other payment methods via the Stripe service, as well as cash or card payment on collection from the shop.

For prepayment, the bank details and the amount are stated in the order confirmation. Please make the transfer within 14 days. We ship the goods after receipt of payment. If payment has not been made after 14 days, we may withdraw from the contract.

5. Delivery and collection

The delivery time is stated with the product and on the Shipping and payment page. For collection from the shop, we will write to you as soon as the order is ready. You can collect it during opening hours (Mon-Fri 9:00-13:00 and 15:00-19:00, Sat 8:00-16:00).

We deliver to Germany, Austria and Switzerland. We ship fresh truffles only chilled by overnight express, at a flat rate of €27.50, with a maximum of 1 kg per order. Depending on preparation, the parcel leaves up to 3 days after the order. If an order contains fresh truffles, this shipping method applies to the whole order.

6. Retention of title

The goods remain our property until paid for in full.

7. Sale to adults only

We sell incense only to persons aged 18 and over. By ordering such items you confirm that you are at least 18 years old. We may ask for proof of identity on handover or collection and cancel the order if there is doubt about your age.

8. Incense and natural products

Items in the Incense category are not a food, not a food supplement and not a medicinal product, and are not intended for consumption. We sell polypores and tree fungi as natural products without a recommendation for consumption. We give no recommendations on preparation, dosage or use for these items.

9. Defects

The statutory rights in respect of defects apply. Please report damaged or incorrect goods as soon as possible, as this helps us to resolve the matter with the carrier. Your statutory rights do not depend on this.

10. Right of withdrawal

Consumers have a right of withdrawal. Details are given in the withdrawal policy at https://shop.mush-room.net/en/withdrawal-policy. You can also declare your withdrawal online at https://shop.mush-room.net/en/withdrawal.

11. Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

12. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which they have their habitual residence.
